Taxes: the items in a set are added together
In Estonia, promotional gifts are subject to specific tax rules, and gift sets have a few important nuances. Below is a short overview, but please consult your accountant about your specific situation.
- VAT: no VAT is charged on a promotional gift if its acquisition cost is up to 10 euros excluding VAT. According to the explanation of the Estonian Tax and Customs Board, the acquisition costs of all items in a set are added together. A set therefore cannot be treated as several separate small gifts.
- Income tax: a promotional gift with a logo given to clients and partners is free of income tax up to 21 euros excluding VAT. Above that limit, the full cost is taxed at the rate of 22/78. According to the Tax and Customs Board example, the cost of printing the logo is not added to the value of the gift: if a mug costs 19.87 € and the logo print 1.68 €, the gift value is 19.87 €, which is below the 21-euro limit.
- Employees: a gift set given to employees does not fall under the 21-euro rule – it is a fringe benefit and is taxed under the fringe benefit rules.
It is good practice to set the budget for the set at the very start of planning. That way you know whether the gift stays within the tax-free limits or whether you are consciously accounting for the tax cost.
Logistics: assembly and delivery
